Terms of Service

These Terms of Service govern your access to and use of Kind Bidder, a fundraising platform that helps nonprofits and personal fundraisers run online auctions, raffles, and giving campaigns. By creating an account, bidding, donating, or otherwise using the platform, you agree to these terms. This page is maintained by Kind Bidder and may be updated from time to time.

1. Accounts

You must provide accurate information when creating an account and keep your login credentials secure. You are responsible for all activity that happens under your account. Organizer accounts may require additional verification, including proof of 501(c)(3) status for nonprofit organizations.

2. Bidding is a binding commitment

Placing a bid is an offer to purchase the lot at that amount. If you are the winning bidder when an auction closes, you are obligated to complete payment using the payment method on file. Automatic (proxy) bids raise your bid on your behalf up to the maximum you set and carry the same obligation.

Bids cannot be retracted once placed. Kind Bidder and the hosting organization may cancel bids or close an auction early where there is an error, suspected fraud, or a listing issue.

3. Buyer's premium and fees

Winning bids may be subject to an applicable buyer's premium and payment processing fees, which are added to the final bid amount at checkout. The buyer's premium — where it applies — is disclosed on the lot or at checkout before payment is completed. By bidding, you agree to pay the final bid amount plus any applicable buyer's premium, processing fees, taxes, and shipping or redemption costs.

4. Payments

Payments are processed by our payment providers. Kind Bidder does not store full card numbers. Failed payments may be retried, and unpaid wins may be reassigned to the next eligible bidder or relisted at the organizer's discretion.

5. Donations and tax deductibility

Contributions to registered 501(c)(3) nonprofit organizations may be tax-deductible to the extent allowed by law, generally limited to the amount paid in excess of the fair market value of goods or services received. Contributions to personal fundraisers are not tax-deductible. Kind Bidder does not provide tax or legal advice; consult your advisor.

6. Fulfillment, travel, and experiences

Fulfillment of items, certificates, travel packages, and experiences is the responsibility of the hosting organization and the item provider, subject to the terms and blackout dates listed with each lot. Travel and experience lots may require additional booking steps and are subject to availability.

7. Refunds and cancellations

All sales are generally final. Refunds are considered only in cases of duplicate charges, listing errors, or items that cannot be fulfilled, and are handled together with the hosting organization.

8. Acceptable use

You agree not to manipulate bidding, use the platform for unlawful purposes, upload content you do not have rights to, scrape the site, or interfere with its operation. We may suspend or terminate accounts that violate these terms.

9. Organizer responsibilities

Organizers are responsible for the accuracy of their listings, the legality of their fundraising activities, delivery of won items, and compliance with applicable charitable solicitation, raffle, and tax rules in their jurisdiction.

10. Disclaimers and limitation of liability

The platform is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Kind Bidder is not liable for indirect or consequential damages, and our total liability relating to your use of the platform is limited to the amounts you paid through the platform in the twelve months before the claim.

SMS Terms

If you opt in to text messages, Kind Bidder may send you auction notifications, bid alerts, account and service updates, and occasional promotional messages.

Consent to receive text messages is not a condition of any purchase or of registering for an auction. Message frequency varies. Message and data rates may apply.

You can reply STOP at any time to opt out of text messages, and reply HELP for help. For support, email hello@kindbidder.com.

11. Changes to these terms

We may update these terms. Continued use of the platform after an update means you accept the revised terms.
